TERMS AND CONDITIONS FOR USE OF THE PTA SOLUTIONS WEB SERVICE

THESE TERMS AND CONDITIONS ARE AN AGREEMENT BETWEEN PTA SOLUTIONS, LLC (hereinafter referred to as "PTAS") WEB SERVICE AND YOU.

PLEASE READ THEM. THEY APPLY TO THE WEB SERVICE NAMED ABOVE. THE TERMS ALSO APPLY TO THE FOLLOWING PTA SOLUTIONS WEB SERVICE:

, AND, THOSE TERMS APPLY. BY USING THE WEB SERVICE, YOU ACCEPT THESE TERMS. IF YOU DO NOT ACCEPT THEM, DO NOT USE THE SERVICE.

1. OVERVIEW. PTA Solutions Web Service contains a database of the families, including parents' and children’s names, class, and a family e-mail address in order to manage lunch services, group e-mail accounts, and automated password resets. In addition, PTA Solutions may contain a vendor contact information, account balance information, and payment information (check number and amount only). We do not store personal financial information on our site.

PRIVACY NOTICE: PTA Solutions Web Service does not sell personal information to third parties.

2. USE RIGHTS. The PTA Solutions web service is acquired on a per school basis. As long as the school's account with PTA Solutions remains in good standing, families who are registered in that school have unlimited access to all of the web service functionality. PTA Solutions does not accept responsibility for server outages that are beyond its control, such as might be expected if the web hosting contractor's system is temporarily unavailable.


3. SCOPE OF LICENSE. The PTA Solutions web service is licensed, not sold. This agreement only gives you rights to use the web service. PTA Solutions reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the web service only as expressly permitted in this agreement. You may not:
• reverse engineer, decompile or disassemble the web service or its underlying software, except and only to the extent that applicable law expressly permits, despite this limitation, or
• use it for commercial software hosting services.


4. ENTIRE AGREEMENT. This agreement is the entire agreement for the use of this web service.


5. DISCLAIMER OF WARRANTY. THE PTA SOLUTIONS WEB SERVICE IS LICENSED “AS IS” AND WITH ALL FAULTS. PTAS GIVES NO EXPRESS WARRANTIES, GUARANTEES OR CONDITIONS. YOU MAY HAVE ADDITIONAL CONSUMER RIGHTS UNDER YOUR LOCAL LAWS THAT THIS AGREEMENT CANNOT CHANGE. TO THE EXTENT PERMITTED UNDER YOUR LOCAL LAWS, WE EXCLUDE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


6. RELEASE OF LIABILITY. PTA Solutions assumes no liability for any harm, real or imagined, which may come as a result of ingesting food that was procured from a third party supplier in the execution of a school lunch program. Acceptance of this End User License Agreement (EULA) for PTA Solutions represents your agreement to release PTA Solutions from liability.


7. LIMITATIONS ON AND EXCLUSIONS OF DAMAGES. YOU CAN RECOVER FROM PTA SOLUTIONS ONLY DIRECT DAMAGES UP TO US$1.00. YOU CANNOT RECOVER ANY OTHER DAMAGES, INCLUDING CONSEQUENTIAL, LOST PROFITS, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES.


8. ACCEPTABLE USE: The PTA Solutions suite of services is made available to client schools whose account remains in good standing for use by members of the school community (administrators, teachers, staff, parents, legal guardians) for the express purposes of managing parent association data. Any other use by users will be considered unacceptable. PTA Solutions reserves the right to disable and/or remove a user account if the user is determined to be accessing web services in any other fashion. Appropriate notice and discussion with the school administration will precede the disabling of a user account
